Laws in India against Sexual Harassment, most of us don't know

This blog is all about the LAWS in India against sexual harassment, most of us are not aware of these laws which I am going to discuss.

There are almost 20 laws in India against sexual harassment everyone should know. So, lets have a look:
1. Singing lewd songs directed at women in public places is considered sexual harassment under IPC section 294. The offenders could be jailed up to 3 months, or be fined or both.
2. Demanding sexual favors despite indication of disinterest is a crime under IPC section 354(A). The accused can either face jail for 1-3 years or fine or both.
3. Following someone with or without their knowledge is stalking and is an act of sexual harassment. The man can face jail for 3-5 years coupled with fine as per IPC section 354(D).
4. If a women's clear refusal to someone's sexual advances is met by threats to harm her physically or her reputation and property, it is a crime under IPC section 503. The man can either face jail time for 2 years or fine or both.
5. Watching, capturing or sharing images of a women engaging in a private act without her consent in voyeurism and is punishable under IPC section 354(C). The man faces jail for 1-3 years in addition to fine. If the man is convicted for second time, then he faces jail for 3-7 years along with fine.
6. In an event that you faced with an act of sexual harassment, you have the right to file an FIR (First Information Report) preferably with the local police station.
7. A senior colleague demanding sexual favors in exchange for work benefits- promotion or salary hike - is an act of sexual harassment as per Sexual Harassment of Women at Workplace, 2013.
8. Morphing pictures of woman and sharing them with an intent to harass and defame her is a crime as per IPC section 499. The punishment may include jail time upto 2 years or fine or both.
9. Any workplace with more than 10 employees should have an internal complaints committee constituted as per the Sexual Harassment of Women at Workplace Act, 2013. Does your workplace have one?
10. Posting any obscene or defamatory material on a public online platform intending to harass a women is a crime under Section 67 of the IT Act. The accused can face jail time of 2 years coupled with a fine.
11. If a women makes a complaint about an act of sexual harassment, the inquiry has to be completed within 90 days according to the Sexual Harassment of Women at Workplace Act, 2013.
12. An FIR (First Information Report) is basically a complaint document and the first step of criminal process.
13. Making sexually colored remarks against a women in a public place is a crime under IPC Section 509.
14. Making unwanted physical contact against women's will is a crime under IPC Section 354(A). The man can face jail term which may extend to three years.
15. Your domestic help is also covered by Sexual Harassment of Women at Workplace Act, 2013. Your home is her workplace.
16. If you have been sexually harassed and decided to file an FIR, ask for the statement to be recorded in a language you understand. If that is not possible, make sure the statement is translated and explained to you by the officer recording it. Insist on every detail being recorded.
17. If an act of sexual harassment happens inside the transportation facility provided by your workplace, you have the right to complain under Sexual Harassment at Workplace Act, 2013.
18. Abusing a women with sexually colored remarks on social media is a crime under IPC Section 509. The man may face jail time of 3 years and fine.
19. According to the Sexual Harassment at Workplace Act, 2013, the committee may take action against the complainant in case of malicious complaints or false evidence. However, simply not being able to prove an allegation will not mean that it is a false/malicious complaint.
20. If you have been sexually harassed, filing an FIR immediately is recommended because you will be able to remember more details about the incident.
